  20. Miscellaneous
    1. Governing Law and Venue This Agreement shall be governed by and construed in accordance with the laws of the State of Utah.  You agree that any action including a mediation and/or arbitration must be brought in Salt Lake City, Utah.  Accordingly, it shall be governed and construed in accordance with the laws of Utah in terms of those applicable to agreements, without regard to conflict of law principles.
    2. Dispute Resolution Any controversy or claim arising out of, or relating to, this Agreement or services provided, shall first be submitted to mediation for an attempt at resolution, with such mediation being conducted by a mutually agreeable party, or if no such party can be agreed upon, by a mediator appointed by the Salt Lake City office of the American Arbitration Association (“AAA”). If  the dispute is not resolved by mediation of not less than six hours duration, the dispute shall be settled by binding arbitration in Salt Lake City, Utah through and in accordance with the rules of AAA then existing. If the parties are unable to mutually agree upon an arbitrator, the AAA as are at issue shall appoint an arbitrator with experience in such matters, but any mediator used in the dispute shall be ineligible unless the parties agree otherwise. The arbitrator shall not have any power to alter, amend, modify or change any of the terms of this Agreement nor to grant any remedy which is either prohibited by the terms of this Agreement, or not available in a court of law.By using the trajectordisability.com website you waive the right to participate in a class action with the AAA.
    3. Modification Neither the course of conduct between the parties nor industry trade practice shall act to modify any provision of this Agreement.
    4. Assignability Trajector Disability may assign its rights and duties under this Agreement to any party at any time without notice to you.
    5. Severability  If any part of this Agreement shall be held to be invalid or unenforceable, that portion shall be construed as much as possible consistent with applicable law and severability shall apply to the remaining portions, so that they remain in full force and effect.
    6. This Agreement Prevails To the extent that anything in or associated with our website is in conflict or inconsistent with this Agreement the terms of this Agreement shall take precedence.
    7. Waiver Failure to enforce any provision of this Agreement shall not be deemed a waiver of the provision nor of the right to enforce the provision.Any rights not expressly granted herein are reserved to trajectordisability.com.
    8. Binding Effect The provisions of this Agreement shall be binding upon and inure to the benefit of the personal representative, successors and assigns of the Parties hereto.

Types of Info Collected

We collect two types of information about our users: Non-Personally Identifiable (“Anonymous”) Information and Personally Identifiable Information.

Personally Identifiable Information (“PII”)Personally Identifiable Information (“PII”) is any information that personally identifies you, such as your name, email address, or your telephone number. This personal information may be requested when you fill out an online inquiry, obtain services from Trajector Disability, subscribe to our email newsletter, or when you contact us. We may ask you to provide us with personal information on a voluntary basis in certain areas of our Website. Additionally, we may purchase and manage opt-in lists generated by third parties that Trajector Disability may use to supplement the PII you provide with additional PII gathered from public or third-party sources. You are under no obligation to provide PII, with the caveat that your refusal to do so may prevent you from using or Trajector Disability from offering certain of the services offered on the Website. Trajector Disability does not request and asks that you do not provide any confidential, proprietary or sensitive PII (“Sensitive Information”), such as Social Security number, driver’s license number, passport number, credit card information, bank account or other financial information. If you submit any Sensitive Information, you do so at your own risk and we will not be liable to you or responsible for any consequences of your submission.
Non-Personally Identifiable Information: This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on our site in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the website’s Uniform Resource Locator (“URL“) that you just came from, which URL you next go to, what browser you are using, and your Internet Protocol (“IP“) address. An IP address is a number that is automatically assigned to your computer whenever you are surfing the web, allowing web servers to locate and identify your computer. Computers require IP addresses in order for users to communicate on the Internet.

Collection Methods and Use of Information

We do not collect any Personally Identifiable Information about you unless you voluntarily provide it to us. You provide certain Personally Identifiable Information to us when you (a) register for our services and register your e-mail address with us; (b) enter sweepstakes or contests sponsored by us or one of our partners; (c) sign up for special offers from selected third parties; (d) send e-mail messages, submit forms or transmit other information by telephone or letter; or (e) submit your credit card or other payment information when ordering and purchasing products and services on our site. Anonymous Information and Third-Party Advertisers

We may use an outside ad serving company to display banner advertisements on our site. As part of their service, they will place a separate cookie on your computer. We will not provide any third-party ad server with any of your Personally Identifiable Information or information about your correspondence with us. We and our third-party ad server will collect and use Anonymous Information about you, such as your IP address, browser type, the server your computer is logged onto, the area code and zip code associated with your server, and whether you responded to a particular ad. Other advertisers may also place banner ads on our site in the same manner as above, but we will not disclose any Personally Identifiable Information to them.

Disclosure Practices

Release of Information

We do not sell, trade, or rent your Personally Identifiable Information to others. We do provide some of our services through contractual arrangements with affiliates, services providers, partners, and other third parties. We and our service partners use your Personally Identifiable Information to operate our sites and to deliver their services. We endeavor to safeguard and protect our users’ personal information. When users make personal information available to us, their personal information is protected both online and offline (to the extent that we maintain any personal information offline). Trajector Disability encourages parents and guardians to spend time online with their children and to participate and monitor the interactive activities of their children.

Sale of Assets
